MEMORANDUM CIRCULAR
NO. 2004 - ____

SUBJECT : Imposition Of The Graduated Fines For Toxic Chemical Substances Under Title II Of Ra 6969 And Its Implementing Rules And Regulations, DENR Administrative Order No. 29, Series Of 1992 (DAO 29,S. 92)

For a more effective system of implementing Chapter XII, Section 43. “Administrative Violations and Fines” of DAO 29, S. 92, a graduated fines and penalties is hereby adopted.

The specific violations and their corresponding amounts of fines are as follows:

a. Non-registration pursuant to the provisions of Title II of DAO 29, Series of 1992 under Priority Chemical List (PCL), Pre-Importation and Pre-Manufactured Notification (PMPIN) and Chemical Control Order (CCO).

- PhP 50,000

b. Operating with Permit/Clearance

- PhP 40,000

c. For Non-Compliance with the conditions of the Permit/Clearance issued, the graduated fines indicated in the table below shall be implemented:

Fine Violation
a) Php 10,000 Non-compliance to one (1) or two (2) conditions
b) Php 20,000 Non-compliance to three (3) or four (4) conditions
c) Php 30,000 Non-compliance to more than four (4) conditions
d) Php 40,000 Non-compliance to more than four (4) conditions and other environmental requirements of this Office
e) Php 50,000 With misrepresentation, inaccurate or inconsistent data/information submitted

With respect to the last violation (item e), an additional administrative sanction of permit and/or clearance revocation as well as possible clean up and rehabilitation of the affected areas is hereby imposed to the violator.

d. Environmental damages and other forms of environmental degradation i.e. spillage,
leak, poisoning and fine accident, among others.

- PhP 50,000

This Memorandum Circular takes effect immediately.
